PA Notary Law Section 19(3)(e) (57 P.S. §165) states “Section 19(e) No notary public may act as such in any transaction in which he is a party directly or pecuniarily interested. For the purpose of this section, none of the following shall constitute a direct or pecuniary interest: . . . (3) receiving a fee that is NOT contingent upon the completion of the notarized transaction.” (Emphasis added). Therefore, my fee cannot be contingent upon the completion of the notarized transaction. If I present documents to borrowers and they do not sign or later do not fund or rescind, I am to be paid pursuant to the Pennsylvania Notary Public Law since I cannot even accept an assignment if my fee is contingent upon the completion of the transaction. I have experience with many types of signings, including: Conventional loans, Refinance loans, HELOC loans, Reverse Mortgage loans, First and Second piggyback loans FHA/VA loans, Purchase / Seller Closings, Structured Settlements/Annuity cash out applications, RESPA applications, Timeshare transfers, Timeshare purchase applications, Resigns, some types of Field Inspections, Loan Modifications. As a Notary Signing Agent, I am a realist because I have seen hills and valleys in the signing business. I should say mountains and gullies since 1999 and there are times I’ve felt like I was on a roller coaster and wonder when the industry will stabilize. I often wonder what is normal in the settlement business. I’ve seen settlement companies fail or file bankruptcy and new ones sprout up over the years. And when I think of what your business and mine will be like when the settlement industry stabilizes, I realize that the hills and mountains will turn into plains (and hopefully not gullies). The times when money was no object are already gone. Money is definitely an object and when the settlement business slows to normal a penny saved will be a penny earned. Therefore, I try to keep my fees fair for all, including myself.
